All facilities with Standard Permits, minor New Source Review [NSR], Prevention of Significant Deterioration [PSD], or Nonattainment New Source Review [NNSR]) and/or Title V permits must renew these periodically, as outlined below, unless specifically stated otherwise in the specific permit.
- NSR Permit: every 5, 10, or 15 years, depending on whether the permit was issued before or after December 1, 1991
- Standard Permit: every 10 years
- Title V Operating Permit: every 5 years
A permit renewal must be submitted to the TCEQ at least six (6) months prior to the expiration date, but no earlier than 18 months prior to the expiration date, or the permit will expire. For example, if a permit expires on December 31, 2026, a permit renewal application must be submitted no later than June 30, 2026 in order to be considered a timely submittal. The TCEQ will send agency notification letters to permit holders approximately 18 months and again at approximately 12 months before the permit expires, advising of renewal requirements and upcoming permit expiration.
Please note that with each NSR permit renewal application, the electronic TCEQ PI-1 Workbook must be used, and all permitted sources at each location must be included. While renewals by certification are available for eligible permits where no modifications have occurred and where the facility remains in compliance with all applicable rules and conditions, it is strongly recommended that all facilities begin preparing their renewal applications well in advance of the six-month deadline to ensure completeness and accuracy. Early preparation is especially important for facilities with complex operations or multiple emission sources, even when pursuing a streamlined renewal.
