Toxic Substance Control Act (TSCA) & Reporting FAQs

TSCA is a federal law enacted in 1976 that authorizes the EPA to regulate chemicals in U.S. commerce. It requires reporting, testing, recordkeeping, and restrictions for certain substances, including PCBs, asbestos, lead, mercury, and formaldehyde.

The TSCA Chemical Substance Inventory is a comprehensive list of chemicals in U.S. commerce. It currently contains approximately 85,000 chemicals, but only those marked as “active” are eligible for ongoing use. Trinity assists companies in verifying their substances and maintaining active status.

Under the Chemical Data Reporting (CDR) rule, manufacturers and importers must report information on chemical manufacture, processing, and use every four years. Reports cover the previous four years of activity, with the next report due in 2024 (covering 2020–2023).

TSCA applies broadly to industries that manufacture, process, import, use, or dispose of chemical substances. This includes chemical manufacturers, industrial facilities, distributors, and federal facilities.
