Air Quality Permitting FAQs

Air permitting is the regulatory process that establishes conditions facilities must meet to control air emissions under the Clean Air Act and related state or local regulations.

Key permits include: 1) Prevention of Significant Deterioration (PSD): For new or modified major sources in areas meeting air quality standards, 2) Nonattainment NSR (NNSR): For new or modified major sources in areas not meeting air quality standards, 3) Minor Source Permits: For smaller projects that don’t trigger PSD or NNSR, 4) Title V Operating Permits: Legally enforceable permits required for major sources and certain regulated facilities.

Any facility constructing or modifying emission sources may require a permit. Major sources, incineration units, and facilities with PSD or NNSR permits must also obtain Title V operating permits.
