NSPS and NESHAP Support

Understanding NSPS, Associated Timelines and How Trinity Can Support

The NSPS, established in 1971 and now expanded to include over 100 subparts, apply to facilities constructed, reconstructed, or modified after a certain date, designated by industrial category or source ype. These standards, based on the “best system of emissions reduction (BSER)” under the Clean Air Act, mandate emissions standards considering costs, environmental impacts, and energy requirements.

Every eight years, the U.S. Environmental Protection Agency (EPA) is required to review and revise where appropriate each NSPS subpart to ensure the standards continue to meet BSER.

Understanding NESHAP Regulations, Timelines, and How Trinity Can Support

Trinity Consultants offers specialized support tailored to Part 63 and 61 NESHAP regulations, which address hazardous air pollutants (HAPs) listed by the Clean Air Act Amendments of 1970. Between 1971 and 1990, the EPA published 23 pollutant-specific standards in Part 61 NESHAP, addressing each of the eight identified HAPs. Unlike the more widely applicable Part 63 NESHAP, Part 61 regulations regulate HAP based on listed activities and emissions source types. These regulations establish human health risk-based emissions standards that provide ample safety margins, safeguarding the public from the listed HAPs.

A residual risk and technology review (RTR) is required to be conducted within eight years of setting the MACT standards, and subsequent Part 63 NESHAP regulation reviews are required every eight years thereafter to account for improvements in air pollution controls and/or prevention.
