On January 24, 2025, the District Department of Energy & Environment (DOEE) proposed to amend the tuning deadline for fuel-burning equipment subject to the Reasonably Available Control Technology (RACT) requirements for Nitrogen Oxides (NOx) emissions under Title 20, Chapter 8, Section 805.5 of the District of Columbia Municipal Regulations (20DCMR 805.5). As stated by DOEE, the proposed amendments are intended to provide flexibility for regulated facilities to meet the required combustion tune-up deadlines while ensuring continued emission reductions during peak heating demand periods. However, these changes may prove more restrictive for many facilities.
