Virginia Signals a New Era of Data Center Oversight

Virginia has long been the nation’s leading market for data center development. As the industry continues to expand, state officials are increasing their focus on the environmental, infrastructure, community and economic impacts associated with large-scale data center projects. On September 18, 2026, Governor Abigail Spanberger introduced the Virginia Data Center Accountability Framework, a comprehensive policy initiative establishing priorities for data center development and operations throughout the Commonwealth. The Governor also issued Executive Order 22 to begin implementing several initiatives, while other measures are expected to require legislation, regulation, or additional agency action.

Organizations planning new facilities, expansions, or long-term investments in Virginia should begin evaluating how these potential requirements could affect project development, permitting, operational costs, and environmental compliance programs. Although some provisions may take years to fully implement, state agencies have already been directed to begin advancing several initiatives, signaling increased regulatory attention on data center development in the near term.

Greater Scrutiny During Project Development

One of the most significant impacts for future data center projects is the proposed increase in public oversight and local involvement. The Framework calls for the elimination of certain development pathways that currently allow projects to move forward with limited local review. Facilities exceeding 25 megawatts of power demand would require local approval regardless of previous zoning or project authorizations. The proposal also seeks to prohibit non-disclosure agreements that restrict public awareness of proposed developments.

Expansion of Environmental Requirements

The Framework proposes a more comprehensive approach to evaluating how data centers affect local air quality, water resources, land use, and surrounding communities. Regulators are expected to place increased emphasis on resource stewardship, cumulative environmental impacts, and long-term sustainability performance throughout a facility’s lifecycle.

Several requirements are proposed as listed below:

  • New water-use standards aimed at reducing overall consumption and improving operational efficiency.
  • Accelerated implementation of statewide data center noise regulations.
  • Additional scrutiny of cooling water demands in areas experiencing water-supply constraints.
  • Cumulative impact evaluations for diesel backup generators.
  • Increased emphasis on cleaner backup generation technologies, including Tier IV or better emission standards.
  • Encouragement of water reuse, waste-heat recovery, and water-positive development practices.

Organizations pursuing data center development in Virginia should anticipate increased regulatory attention to environmental performance and begin evaluating opportunities to demonstrate leadership in resource stewardship.

Increased Emphasis on Clean Energy and Grid Reliability

Proposed measures in the Framework include limiting reliance on on-site natural gas generation, encouraging greater adoption of renewable energy resources, and requiring facilities to contribute to grid reliability through flexible operations and energy storage solutions. The Framework also seeks to prioritize grid access for projects that demonstrate stronger commitments to clean energy procurement and reduced emissions profiles.

Additionally, the Framework seeks to ensure that energy costs associated with serving large data center loads are borne primarily by the facilities driving that demand, rather than being shared across other utility customers. While specific implementation details remain under development, the proposal signals a continued trend toward greater scrutiny of power demand, utility interconnection requirements, and long-term energy planning.

Understanding the Potential Impacts on Data Center Projects

Although many provisions of the Virginia Data Center Accountability Framework are still in the proposal stage, the document provides a strong indication of future regulatory and legislative priorities within Virginia. Data center developers, operators, and investors should proactively evaluate how evolving requirements may affect site selection, permitting, environmental compliance, energy procurement and community engagement strategies.

Data centers planning expansions or new development in Virginia should consider conducting early assessments of water consumption, air emissions, energy infrastructure needs, community impacts, and sustainability performance to position projects for future regulatory changes.
